BACK CREEK KENNEL GUARANTEE AND SALES AGREEMENT

Retrievers purchased at Back Creek Kennel (BCK) are sold with a written health guarantee that is in effect for seven (7) days after the dog leaves BCK.   During this seven-day period, the buyer should have their dog examined by a licensed veterinarian.   If, for any reason the buyer is not satisfied with the health of his or her dog, the buyer may return the dog at his or her expense for a full purchase price refund, provided the dog is in the same condition as when sold.   All veterinary costs for said dog after departure from BCK, no matter what the reason and including the seven (7) day period is the responsibility of the buyer.  

All BCK retrievers are guaranteed to be functionally free of hereditary hip dysplasia and functionally free of hereditary eye defects, disease or abnormalities through 26 months of age.   If your BCK retriever develops a life-threatening or life-altering illness that is found to be hereditary in nature (such as debilitating hip dysplasia or PRA), before the age of twenty six (26) months, I will (at my option) do one of three things:  A) replace the dog from another comparable breeding (and include similar training if the dog is sold as a started retriever) when such a dog becomes available; B) pay the veterinary cost to correct the problem not to exceed the dog’s original purchase price; or C) refund the full purchase price.  If you choose to keep the dog as a pet and do not choose to receive a replacement dog, a refund of 1/2 the original purchase price will be made pending conformation from a licensed veterinarian that the dog has been spayed or neutered.  

 In order for BCK to fulfill this guarantee, the following conditions must be met:

1)    You must notify BCK in writing of the reason for fulfilling of the BCK guarantee.

2)    The dog must be no older than 26 months of age.

3)    You must be the dog's original owner and only owner.

4)    The dog must not have produced offspring.

5)    Dog ownership and AKC Registration will be transferred as directed by BCK.

 6)    The dog will be transported or shipped to BCK at the owner's expense or, at the option of BCK,  dog will be neutered by a veterinarian and written certification of such procedure is sent to BCK.

7)    The breeder may request that the dog's owner obtain further opinions in the case of x-rays and/or eyes.  Any additional opinions will be the responsibility of the dog's owner.

8)    The dog must have been reared with good care,  shelter,  quality nutrition,  and vaccinations administered at the recommended frequency .  The dog must not be allowed to become overweight or be overworked, especially at an early age.  The dog should show no signs of neglect or cruelty.

9)    All or any of the above requirements may be waived at the discretion of BCK.

If at any time during the life of  this dog the buyer cannot keep it, the buyer agrees to contact the breeder who has the right of first refusal at a purchase price not to exceed fair market value.   If the dog is sold or placed in another home, without notification to the breeder, this guarantee is null and void. 

By signing this Guarantee and Sales Agreement, the buyer acknowledges having read this document in its entirety and agrees to all terms and conditions as set forth within.
